The Supreme Court dismissed 6 of the 7 grounds of appeal filed by David Mark. The only appeal granted by the Supreme Court was the one relating to the order to maintain status quo ante bellum.
The view of the Supreme Court was that the only court that could make an order of status quo ante bellum was a court that had proceedings pending before it, and since the Court of Appeal had correctly held that the appeal filed by David Mark was incompetent, there was nothing pending before the Court of Appeal to which it could make an order of status quo ante bellum.
The appeal by David Mark failed because the real objective of the appeal was to get the Supreme Court to decide the issue of whether or not the claim before the Federal High Court was justiciable. We are going back to the Federal High Court for the case to be heard on its merits.
