COURT OF APPEAL DISMISSES SUIT OVER NULLIFIED NATIONAL CONVENTION; UPHOLDS SUSPENSION OF A.K. AJIBADE, OTHERS, DECLINES TO GRANT LEGITIMACY TO ABDULRHAMAN PURPORTED CARETAKER COMMITTEE.

ABUJA, NIGERIA

The Court of Appeal sitting in Abuja has declared the legal dispute surrounding the party’s controversial National Convention entirely moot, ruling that no "live issues" remain for determination following the Supreme Court's absolute nullification of the event.

In a decisive judgment that reshapes the party's current administrative landscape, the appellate court clarified that because the foundation of the appeal, the National Convention in Ibadan has already been completely wiped out by the apex court, proceeding with a retrial would serve no useful legal purpose or judicial utility.

Crucially, the Court of Appeal declined to grant legitimacy to the purported caretaker committee led by Abdulrahman Mohammed, leaving it without judicial affirmation.

However, the judgment delivered a definitive blow to the previous administration's holdouts. The Court explicitly upheld the suspension of A.K. Ajibade, ruling unequivocally that he lacks any legal capacity or power to act, speak, or transact business on behalf of the Party.

Furthermore, the appellate court noted that clear evidence presented before it proved that the tenure of office of the embattled officials had fully expired. The Court emphasized that the defendants (Abdulrahman Mohammed) failed to produce any evidence showing they were constitutionally re-elected to their positions after their mandates lapsed.

By clearing the docket of the defunct convention dispute while simultaneously stripping unconstitutional actors of any pretense of authority, the Court of Appeal has effectively closed the door on expired tenures. The judgment leaves a clear path for the party to move forward, free from the interference of suspended officials, to resolve its leadership through fresh, lawful, and constitutionally valid processes.
